Obtaining Compensation After an NYC Bus Crash

Superior Skill, Superior Work Ethic, Superior Results

Bus collisions can cause serious injuries to victims, and while bus companies would like us to believe they just don’t happen, we’ve seen plenty of cases here in New York. Here are a few from the past two years.

  • In May 2023, 14 were injured in an NYC crash between an MTA bus and multiple cars.
  • In April 2023, a car and a school bus crashed north of NYC.
  • In August 2022, an MTA bus slammed into an elevated NYC subway pillar, hurting 12 people.
  • In July 2022, an NYC school bus injured 3.

Fortunately, bus crash victims have just as many legal rights to collect compensation as any accident victim.

The liable party varies. While talking about buses that may immediately bring MTA buses or school buses to mind, transit buses aren’t the only types that get into trouble. Several private bus companies are operating in New York, many with a rather dismal track record regarding safety.

In either case, there are a few steps you can take.

Contact Your Own Insurance Company

If you have a car and thus a driver’s insurance policy, you can often benefit from your own no-fault policy. In fact, you can’t sue either the city or a bus company until you meet the severe injury threshold, but you can collect no-fault benefits any time you’re injured by a vehicle.

Of course, many people in New York don’t drive at all. Roughly 29% of New Yorkers don’t drive. If so, you will need an attorney’s help to recover compensation.

File a Notice of Claim

If you were in an accident with a private bus company, the process moves more like a typical personal injury claim.

If you were in an MTA bus accident, you must move much faster. You’ll have to file a Notice of Claim to sue MTA and have just 90 days to complete that.

Suing any city entity is difficult, so secure an attorney as soon as you’re medically capable of doing so.
